why does it say "RoR 0.39 required?" does he have 0.39 beta?
It says "RoR 0.39 required" because of some 0.39 features are needed to get new buildings of the newest beta. To be exact, Mitchieboy® ran out of the collision limit, so that some buildings and streets where non-contactable. With RoR 0.39, you can increase this limit easily, with 0.38, you can't.
To your question if he has the 0.39 beta, yes he has it. I have it, too, and to be exact, everyone can have it. But you can't simply download it, you have to compile it yourself. How? That's described in the wiki, but I want to add that you need some good knowledge about what you do or you will fail.

The only alternative to get 0.39 without compiling it yourself is donating money to become an silver donator. This way, you help the developers and get something in return, too.

As far as I have understand, it's not absolutely required, but some parts of the motorway may be not contactable.

It will take the map, so the game won't crash when you load it up, you can still use it, but as Creak said, some things won't be contactable.

I have a problem with installing 0.39 and waiting for it is too long,so why cant you make it for .38 anymore??

You don't have to install it, you have to compile it. You can look up a detailed description on how to do it at the wiki, but if you don't know the difference between installing and compiling, better don't try it.
RoR 0.39 required, works with RoR 0.38, but you will experience collision problems in some places.
